One type of
contract that requires special processing is the consulting contracts.
All consultant contracts shall be processed by the Contracts Office of
UTPA, who shall determine what documentation shall be submitted by the
requesting department as detailed in accordance to Business Process
Memorandum 43. Ref:

The State’s
definition of a Consulting Service is as follows: ‘the service of
studying or advising a state agency under a contract that does not
involve the traditional relationship of employer and employee; services
which include the study and advice with respect to some aspect of an
agency’s operations or management.”
Limitation on
Who May Be a Consultant
An individual who
has been employed previously by the institution within the past twelve
months may not be hired as a consultant if appropriated funds are used
to pay the consultant. Ref: Texas Government Code § 2252.901.
In addition, there
are certain disclosure requirements applicable to a proposed consultant
who was previously employed by the institution during the preceding two
years. Ref: Texas Government Code § 2254.033
