Section 3: HUB Program

1.  General Requirements 

According to the Texas Government Code, Title 10, Subtitle D, Section 2161, the Texas Building and Procurement Commission (TBPC) is responsible for managing the State's Historically Underutilized Business (HUB) Program for ethnic minority and woman-owned businesses. TBPC is required to prepare a 6-month (Semiannual) and a 12-month (Annual) statewide-consolidated HUB Report of total expenditures. The report identifies the purchases in six (6) procurement categories described as Heavy Construction, Building Construction, Special Trade, Professional Services, Other Services and Commodities.  This report is submitted to the Governor, the presiding officer of each House of the Legislature, the members of the Legislature, and the Joint Select Committee. 

2.  Agency Reporting 

For each reporting period above, the State Comptroller of Public Accounts submits expenditure data on payments made from funds deposited and maintained in the State Treasury to the TBPC.  State agencies, including institutions of higher education, must submit expenditure data on payments made from funds that are not deposited or maintained in the State Treasury to the TBPC.  Additionally, agencies must include data on any HUB subcontracting participation for payments made from all funds.   

In addition to submitting the above expenditure data, agencies must also submit the following reports: 

Mandatory: 

  • Number of businesses participating in state bond issuances
  • Number of HUBs submitting bids and/or proposals for the acquisition, construction, equipping, or operational implementation of state facilities or programs
  • Number of contracts awarded to HUBs
  • Grand total of agency contracts awarded (HUBs and Non-HUBs)

Optional: 

  • Supplemental Summary Letter which delineates an agency’s good faith efforts regarding procurement opportunities for HUBs

Other Reports: 

  • HUB Strategic Plan Progress Report submitted as part of the Annual Financial Report
  • HUB Compliance Report submitted as part of the Legislative Appropriations Request
  • HUB Program Progress Reports as requested by U. T. System Administration
  • Internal Monthly HUB Utilization Reports
